Portland man charged with assaulting federal officer during protest near ICE facility

A Portland resident appeared in federal court following allegations of assaulting a federal law enforcement officer near the U.S. Immigration and Customs Enforcement (ICE) office in South Portland.

Devin P. Montgomery, 49, faces a felony charge for allegedly assaulting a federal officer. According to court documents, on September 4, 2025, Federal Protective Service (FPS) officers observed Montgomery operating a drone within a temporary flight restricted area close to the ICE facility. The FPS informed Montgomery that flying drones in the area was prohibited under restrictions set by the Federal Aviation Administration. Despite these instructions, Montgomery continued to operate the drone.

Federal officers approached Montgomery, who reportedly became confrontational and used profanities toward them. After being arrested, he is accused of spitting in an officer’s face.

Since June 13, 2025, authorities have charged 26 individuals with various federal offenses at the ICE building. These charges include assaulting federal officers, arson, possession of destructive devices, and damage to government property.

Montgomery made his initial appearance before a U.S. Magistrate Judge and was released under certain conditions pending further proceedings.
